1. Information Collected

When a user registers on our Web site, we directly collect during our initial registration process the registrant's user name, the registrant's password, the registrant’s date of birth and the registrant’s parent's email address(es). When a Web site registrant becomes a paying member, we collect additional personally identifiable information from the registrant's parent, including the parent's full name, name and address for prizes to be mailed to, credit card billing information including mailing address, and such other information as may be requested from time to time. This Web site does not condition participation in an online activity on providing more personal information than is reasonably necessary for that activity.

This Web site requires users to provide a parent's valid email address in order to register on the Web site. We use this information to send the parent a message that can be used to activate the account, to allow the parent and child to participate in the “Coach’s Challenge” feature, to notify the parent about changes to our User Agreement or Privacy Policy, and to send the parent communications about the account, our products and services, products and services provided by our affiliates or sponsors, and for the other purposes described in this Privacy Policy.

We may also request a username, email address, phone number and other information when a user submits a form through "Contact Us", “Submit Feedback”, “Ask Coach” and other similar features of the Web site. For some of our other features, such as “Coach’s Challenge”, polls and contests, we may ask users to provide other information such as a user's exercise accomplishments, favorite color or favorite game.

We enable users to chat online through our Web site and also communicate with other users through features “Field Notes” and “Ask Coach”, but we take measures to discourage users from communicating personal contact information through these functions. We keep a private log of all of these activities which we review from time to time to help ensure user safety and security.

Additionally, when visitors come to our site, we may passively collect certain non-personally identifiable computer information, such as the type of computer operating system (e.g., Windows XP or Mac OS), the user's IP Address, the web browser (e.g., Firefox, Internet Explorer) being used, and information regarding the Internet service provider. We may link this information to user information that we have collected.

Finally, we collect financial information as set out in Section 7 of this Privacy Policy. We do not use this financial information for any purpose other than processing payments. The credit card number that you enter to purchase a membership is not stored by us, but, instead, is retained by our payments processing vendor for the purpose of processing credit card payments.

If the personal information described above is not provided to us, then we may not provide access to the Web site or certain content and functionality of the Web site, or to provide other information, products or services which may be requested.

2. Use and Disclosure of Information Collect

In addition to the purposes described in Section 1, we may actively collect and use email addresses and usernames to track usage and to ensure users are following the Web site's Terms of Use. In addition, we may use an email address, username, IP address or other personally identifiable information to ban a user temporarily or permanently from the Web site if that user engages in inappropriate conduct on the Web site. We may also use email addresses and usernames to enable parents to review information that their children have submitted to the Web site. We also may use information in the aggregate to analyze site usage, as well as to offer products, programs, services, contests or prizes from us or our affiliates or sponsors. In addition, we may use certain information to determine eligibility for our products, services, contests and prizes.

We may disclose information where we are required to do so by law, for example, in response to a court order or a subpoena, or where we disclose personally identifiable information to service providers or other group companies who provide support for the operations of our Web site and who do not use or disclose the personally identifiable information for any other purpose. To the extent permitted by applicable law, we also may disclose personally identifiable information in response to a law enforcement agency's or other public agency's (including schools or children services) request or if we feel that such disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our website, protect the security or integrity of our Web site, or enable us to take precautions against liability.

We may disclose information to third parties to perform processing and other specialized services. At times, we may use outside organizations to perform specialized services such as, but not limited to, credit card processing, mailing and shipping, prize fulfillment of our sweepstakes and skill contests, or collection of overdue accounts. These service providers are only given the information needed to perform those services.

If we sell all or part of our business or make a sale or transfer of our assets or are otherwise involved in a merger or business transfer, we may transfer personally identifiable information to a third party as part of that transaction, to the extent permitted by applicable law.

Finally, we may transfer personally identifiable information and store it outside of the jurisdiction in which a Web site member is located.

3. Use of Cookies

We may use software technologies such as unique identifiers or "cookies." Cookies are small text files that we place in visitors' computer browsers to store their preferences. Where we link these unique identifiers with your other personally identifiable information, we will treat the unique identifiers as personally identifiable information as long as they are linked. We do use unique identifiers to learn about usage of our site, such as geographic location, how many visitors we have and how often they visit various sections of our site.

4. Giving, Selling, Trading or Renting Information Collected to Third-Party Sponsors

We will not give, sell, trade or rent your personally identifiable information to any third-party sponsor. We may, from time to time, distribute an advertisement or promotion to you directly on behalf of a third-party or sponsor (via the parent(s) e-mail addresses, billing address and/or shipping address you provided to us, and/or by placement of the advertisement or promotion inside the Web site). In those instances, we will facilitate the distribution of the advertisement or promotion ourselves, and we will not give your personally identifiable information to the sponsor. This section is not intended to limit any of the uses or disclosures of information described in section 2 above, so in the event of any conflict between this section and section 2, the provisions of section 2 shall prevail.

5 .Links to Third Party Sites

Users may, through hypertext or other computer "links," gain access to other Web sites on the Internet which are not operated by us. We are providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by us of the Web site linked to. We assume no responsibility for any material outside of the Web sites we operate.

6. Security of Information Collected

We have put in place appropriate physical, electronic, and managerial procedures to help safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online.

7. Financial Information Collected

As noted in Section 1, if you decide to purchase a membership, additional financial information will be required at the time of purchase. We will collect and store your billing name, address and contact information. Your credit card number and expiration date are not stored by us, and, instead, are collected and stored by our payments processing vendor for the purpose of processing payments made to us.

8. Access and Objection to Information Collected

Please contact us as provided in Section 9 if you would like to access the personally identifiable information that we have collected online from you (and your child if you are a parent or guardian), correct factual errors in such information, request to have this information deleted, request that we no longer collect or maintain such information, or if you would like information about the organizations we disclose personally identifiable information to and how to contact them.

Please be sure to include your email address and a telephone number where we can reach you. In order to maintain privacy, we will take reasonable steps to help verify your identity (and your child’s identity if you are a parent or guardian) before granting you access to the information.
